Smart Buildings Create Smart Evidence

Modern buildings collect more data than many owners realize. Cameras, key fobs, access cards, elevator logs, tenant portals, package systems, smart thermostats, leak sensors and text messages can all become evidence in real estate litigation.

On the Price of Business, Alexander Paykin, Esq. discussed why building owners, boards, landlords, managing agents and developers should understand their data before a dispute arises. In New York, once litigation is reasonably anticipated, parties may have duties to preserve relevant evidence. Losing or deleting building data can create sanctions risk.

The privacy side also matters. New York has cybersecurity, monitoring and eavesdropping laws that may affect how building data is collected and used. Other states go even further in certain areas, such as Illinois with biometric data and California with consumer privacy rights.

The takeaway is that smart-building systems are not just operational tools. They are future evidence.
