Robert H. Bork Jr.’s 2026 book, The New Paradox: Antitrust and the Threat of Conservative Socialism, co-authored with Mark W. Davis, critiques a dramatic shift in American politics. The authors argue that modern conservative and Republican policymakers are abandoning traditional free-market principles. Instead of protecting open competition, these regulators are allegedly adopting interventionist, big-government antitrust policies to achieve specific political goals.
Bork and Davis warn that this pivot mirrors left-wing regulatory overreach, creating a “conservative socialism” that threatens economic freedom. By moving away from the classic “consumer welfare standard”—a legal benchmark championed by Bork’s late father, Judge Robert Bork—new policies risk weaponizing antitrust law against private businesses. The 159-page volume serves as a warning to conservatives, urging a return to judicial restraint and market-driven capitalism.
