Recently Kevin Price, Host of the nationally syndicated Price of Business Show, interviewed David Dozier who is a leading media authority.

The Supreme Court has roundly rejected prior restraint of the press. In Near v. Minnesota (1931) and the famous 1971 “Pentagon Papers” ruling, the Court ruled that other interests are subordinate to freedom of the press. If the publication of news causes harm, those harmed can only sue after the fact. On Aug. 11, Marion (Kansas) Police Chief Gideon Cody raided the Marion County Record. The 1,900 residents of Marion are deeply conservative; 74% voted for Trump in 2020.  Police hauled off computers, servers, a reporter’s cellphone and files. The pretext of the seizure was an unpublished story about a restaurant owner, her prior DUI and her efforts to renew her restaurant’s liquor license. Significantly, also seized were unpublished notes about Cody, the police chief. He left the Kansas City Police Department while under investigation for sexual harassment and possible demotion. His current job pays about half his salary in Kansas City. Marion County’s top prosecutor ruled that there was insufficient evidence to justify the search and seizure of the newspaper. He ordered the police to return all notes and property to the newspaper. As a result of the raid, 35 news organizations protested this effort at prior restraint.
