Is the Case Against Journalist Don Lemon Vindictive Prosecution?

On a recent Price of Business show, Host Kevin Price interviewed Dr. David Dozier. He’s a professor emeritus in the journalism school at San Diego State University. They discussed felony charges against Don Lemon, a former CNN newscaster and now an “independent journalist.” Last January in St. Paul, parishioners gathered for Sunday services. A church pastor, not present at the service, was also a ranking official with ICE. Lemon accompanied anti-ICE protesters who entered the church. Federal prosecutors charged over 30 protesters, including Lemon. He is charged with two felonies. Lemon and Georgia Fort, another “independent journalist” who was also charged for entering the church, argue that they were not protesters. They were reporters covering the protest. Lemon does not work for a legacy news organization. His reporting is distributed on his YouTube show. In principle, anyone with a smartphone can upload newsworthy events to YouTube. Is anyone with a smartphone an “independent journalist?” In August, Lemon’s lawyers filed a motion to dismiss charges against Lemon. They argue that Trump’s ongoing personal attacks on Lemon indicate his prosecution is vindictive. According to Cornell Law School, vindictive prosecution means charging defendants with more severe crimes to punish them for exercising their legal rights. Vindictive prosecution violates due process. It’s meant to intimidate and browbeat defendants, not win guilty verdicts in court.
