While Democrats search for someone – anyone – to blame for the loss to Donald Trump, few point the finger at Special Prosecutor Jack Smith. Rather than indicting Trump on a straightforward obstruction case for Mar-a-Lago withholding of documents, he went overboard to try to smear Trump and his supporters by bringing a wide sprawl of charges.
As we will show, this overcharging led Smith to defeat and Trump to victory, as Trump appeared to be a victim of Smith’s overcharging. And overcharging Smith did. Ultimately, this led to an immunity ruling and then led to Smith’s disqualification as Special Counsel, which in turn led to dismissal of his Mar-a-Lago obstruction case. All of this failure was the result of an improper use of prosecutorial power for political purposes. The media contributed by singing from Smith’s song sheet, lending the Democrats a feeling of invulnerability. But in the end, this hubris led to the election of Donald J. Trump.
