Label AI Political Deepfakes Through Least Restrictive Means

Recently Kevin Price, Host of the nationally syndicated Price of Business Show, interviewed David Dozier who is a leading media authority.

Generative artificial intelligence (GenAI) can manipulate real video and audio recordings of politicians and candidates to look like and sound like something they never said. Such deepfakes can be so realistic that they can fool unsuspecting media consumers. An example is a deepfake where Vice President Kamala Harris portrays herself as an unqualified diversity candidate and tool of the so-called “deep state.”

California passed a law (AB 2839) requiring producers of such deepfake content to clearly label it as manipulated content. However, U.S. District Judge John Mendez (appointed by George W. Bush) temporarily blocked the law, arguing the law was overly broad and violated the First Amendment. The First Amendment does protect politicians who lie. In political advertising, the Federal Election Commission (FEC) requires political advertising to disclose its sponsor, the only legal protection for media consumers. The FEC established disclosure requirements that minimize restrictions on political speech. Mendez correctly asserted that sponsors must notify consumers that deepfake video and audio recordings are manipulated through the least restrictive means. The California legislature needs to revisit AB 2839 to accomplish its laudatory goals of informing media consumers of deepfakes through the least restrictive means (DavidDozierBooks.com).
