Why Dominion Did Not Demand More From Fox News

Recently Kevin Price, Host of the nationally syndicated Price of Business Show, interviewed David Dozier who is a leading media authority.

On April 17, Fox News agreed to pay $787.5 million to Dominion Voting Systems for lies that Fox told on-air about Dominion switching votes from Trump to Biden in the 2020 election. Fox was also forced to admit that “certain claims about Dominion” were false. During discovery, Dominion discovered that several of Fox’s on-air performers knew that they were spreading false information. Fox was not required to make an apology or an on-air correction for these lies in a prominently conspicuous manner. Many were disappointed. They wanted on-air performers and the Murdock family to testify under oath. Dominion, however, is a for-profit corporation that manufactures voting machines and software to run them. With a solid offer of $787.5 million from Fox, Dominion needed to assess the risks of going to trial. Through negotiations, Dominion extracted nearly half of the $1.6 billion originally sought. Dominion probably never expected a settlement that large. The key risk of going to trial is the issue of jury nullification. Nullification occurs when an accused party or defendant (Fox) is clearly guilty but the jury finds in favor of the defendant anyway. During the Civil Rights Movement, murderous Klansmen were found not guilty by Southern all-white juries, despite overwhelming evidence to the contrary. Dominion’s lawyers would have to convince all 12 jurors that Fox defamed Dominion. Ferreting out MAGA infiltrators during jury selection would have been a very risky endeavor. Only one dedicated MAGA infiltrator would be needed for a hung jury (DavidDozierBooks.com).
